D&M Planning has successfully demonstrated that a former domestic building has been used as a self-contained, independent dwellinghouse by virtue of the granting of a Certificate of Lawfulness of Existing Use and or Development.

In granting the Certificate, the council said ‘Having regard to the submitted information and other evidence available, officers are of the view, that on the balance of probability the development described in the application has taken place for a period of at least 4 years until the point at which the application was made.’
