Following a ‘split-decision’ by the Council for the change of use of the building from a dwellinghouse to a dwellinghouse and bed and breakfast mixed use (approved) and adjoining land as long-stay airport parking sui generis (refused), D&M Planning successfully argued the acceptability of the refused element (long-stay airport parking) at appeal.

Although located within the Metropolitan Green Belt and outside of the control of Gatwick Airport, D&M successfully argued a fall-back position for the use of the land if were not be used for airport parking related to the bed and breakfast use and this would result in no greater harm to the openness of the Green Belt should the appeal be allowed.

The appointed Inspector agreed with this view and allowed the appeal.
