Enforcement Notice Quashed

D&M Planning Ltd have successfully appealed an enforcement notice, on behalf of a longstanding client, served by Guildford Borough Council with the Inspector quashing the notice. Following a two week public inquiry during which Matt was subject to examination and cross examination, the Inspector has agreed with the key principles put forward by D&M Planning in conjunction with the appointed Counsel. As put forward, the notice was fatally flawed by the absence of a component of the alleged mixed use. Building on existing case law it was argued that to amend such would be prejudicial to the client. The Inspector agreed in full and quashed the notice.
