Successful appeal against the decision of Surrey Heath Borough Council

D&M Planning have successfully achieved planning permission for a single storey rear extension following an appeal to the Planning Inspectorate. Surrey Heath Borough Council refused the application based on the likely impact on adjacent protected trees, however, D&M, in conjunction with appointed arboriculturalist, successfully argued that the proposal would not likely have the impact foreseen by the Council. In reaching their decision, the Inspector states that ‘on the balance of probability, and from the evidence before me, I am satisfied the proposed development would not have a significantly detrimental effect on the health and longevity of the trees protected by TPO.’
