Removal of Condition restriction Permitted Development

D&M Planning Ltd have successfully argued for the removal of a condition that sought to prevent any extensions or outbuildings being erected by way of the General Permitted Development Order. The owners of the property, located in the Green Belt and Surrey Hills, previously had permission for a new garage on site and in granting permission Waverley Borough Council thought it appropriate to remove permitted development rights. This is a fairly common eventuality in a number of authorities.

D&M Planning managed to successfully argue, however, that the condition could not be considered reasonable and it should be removed. In reaching their conclusion the officers agreed with all of the submissions made by D&M Planning and agreed the condition was unreasonable.

The client is now able to undertaken further development on their site under the virtues of the General Permitted Development Order.
